In short. Have a Gander is an early build that learns your taste in films and series and helps you and your friends pick something to watch. It will change as we build it. Its predictions are estimates, not promises. Be decent to the people you invite. Your data is yours, and you can leave at any time.

1. Who we are, and when these terms apply

Have a Gander is provided by Hagworks, a sole proprietorship (eenmanszaak) owned by Maurits van ’t Hag, the Netherlands (registration with the KvK, the Dutch Chamber of Commerce, is in progress), support@haveagander.app. These terms apply to the Have a Gander app for Android, to the version that runs in a browser, and to an iPhone version once it exists. During the preview the app may still call itself by its working title, Rated. By creating an account or using the app you agree to these terms. Our privacy policy explains how we handle personal data.

2. The service

Have a Gander lets you rate films and series, predicts how you will rate others, suggests what to watch, lets you compare tastes with friends you invite, and runs movie nights where a group picks a title together. It is an early build: features are being added, changed and sometimes removed, and things may not always work as intended. Using it is free for now.

If we ever offer paid features, what they include and what they cost will be shown in the app before you pay, and these terms will be updated with the conditions that apply to them first.

3. Predictions are estimates

Predicted scores, taste matches, statistics and suggestions are worked out from ratings and can be wrong. They are there to help you choose, not to tell you what you will enjoy. Information about films and series, including posters and the crowd score, comes from TMDB and may be incomplete or out of date. This product uses the TMDB API but is not endorsed or certified by TMDB.

5. Friends, notes and fair use

Have a Gander is for people you know. You choose who becomes your friend, by sharing your invite link or joining someone’s movie night. There is zero tolerance for harassment, hate, threats, sexual content involving minors, or spam, in your name or in the notes you send.

We may remove what breaks these rules, or close the account behind it, and will tell you why unless the law or someone’s safety stands in the way.

6. Your data

Your ratings, lists and notes are yours. You give us permission to store them and use them to provide the service to you, and to show them to the friends you choose, for as long as you have an account. You can have everything deleted at any time; see Delete your account.

7. Availability and changes to the service

We work to keep the service up, your data safe, and to fix what breaks, but we cannot promise that Have a Gander is always available or free of errors, especially while it is an early build. If we ever decide to stop the service, we will tell you at least one month in advance and give you the chance to get a copy of your data.

8. Liability

Have a Gander is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, such as an evening spent on a film the app was sure you would love, or for loss caused by services we depend on. Our total liability towards you is limited to €50. None of this limits liability for damage caused by our intent or gross negligence, or any right you have under mandatory consumer law.

9. Ending

You can stop using Have a Gander and delete your account at any time. We may close an account that seriously or repeatedly breaks these terms.

10. Changes to these terms

We may update these terms, for example when the app gains new features or the law changes. If a change matters, the app tells you before you continue, and you can delete your account if you do not agree. The date at the top shows the latest version.

11. Law and disputes

These terms are governed by Dutch law. If you live in another EU country, you keep the protection of the mandatory consumer law of that country. If you have a complaint, write to support@haveagander.app first; we aim to answer within 14 days. If we cannot solve it together, the competent court in the Netherlands decides, or the court where you live if consumer law gives you that choice.
